The United States Patent and Trademark Office (USPTO) will implement a new fee schedule this month, introducing significant changes across all fee categories, including initial trademark application filing fees.
Currently, trademark application filing fees are $250 for applications filed using descriptions from the USPTO’s identification manual or $350 for those filed “off the menu” with custom descriptions. Under the new fee schedule, all applications will have a base fee of $350, with an additional $200 charge for “off-menu” descriptions. Additionally, if a description exceeds 1,000 characters, a further $200 fee will apply.
To benefit from the current lower rates, trademark applications must be filed on or before January 17, 2025. Filing now could offer significant cost savings for individuals or businesses considering a new trademark application.
Renewal and maintenance fees are also increasing. Trademark holders should be aware that:

- Maintenance filings are required between years five and six of registration.
- Renewal filings are required every 10 years.
The filing period for these requirements is a year long. For filings due between now and January 17, 2026, filing before January 17, 2025, could help reduce costs under the current fee structure.
