This panel will update you on recent developments in case law, including analysis of the disparate impact decision by the United States Supreme Court in the Texas Department of Housing and Community Affairs v. Inclusive Communities Project, Inc. and HUD’s subsequent enactment of the Affirmatively Furthering Fair Housing rule. In addition, it will present on the recent inclusionary zoning ruling from the California Supreme Court in California Building Industry Association v. City of San Jose, to shed light on how inclusionary zoning is one tool to combat segregation.
The panelists will debate the free market provision of affordable housing versus the aim of government funded affordable housing that affirmatively furthers fair housing through the lens of land use planning policies.
