Since 2017, Foster Garvey has been working with The Veterans Consortium Pro Bono Program to assist veterans and family members who have been denied disability benefits by the Veterans Affairs (“VA”) system. Three such recent cases involve a widow pursuing a claim on behalf of her Navy veteran husband, who passed away while his disability benefit claim was pending at the VA, and was seeking back disability benefits for his back and hip disabilities; a Navy veteran in Bellingham, Washington, who suffered injuries to his mouth while in service; and a Navy and Army veteran suffering from neck, elbow and shoulder disabilities.
In all three cases, Foster Garvey attorneys reviewed extensive medical, VA and service records, filed initial briefing on the issues, and participated in settlement conferences with VA attorneys. In two of the cases, the VA agreed to reconsider the issues in each case without further briefing. In the third, Foster Garvey attorneys filed multiple additional briefs with the Court and received a final ruling from the Court, forcing the VA to reconsider its denial of disability benefits. Participating from Foster Garvey were Ben Hodges, Devra Cohen and Kelly Mennemeier.
